By accessing our website, creating an account, purchasing a subscription, or using any of our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the site or services.

1) Who We Are

Brandymail provides email branding, authentication, monitoring, and certificate-related services, including (without limitation) DMARC/SPF/DKIM tooling, domain health monitoring, notifications/alerts, and services related to Verified Mark Certificates (VMC) and Common Mark Certificates (CMC) and related brand/mark enablement. 2) Definitions

• "Account": Your Brandymail user account.
• "Customer," "you," "your": The person or entity using the Services.
• "Services": The subscription services, tools, dashboards, monitoring, alerts, and certificate-related support provided by Brandymail.
• "Certificate": A digital certificate such as a VMC, CMC, or other mark/certificate product you purchase through us (where offered).
• "Certificate Provider": A third-party certificate authority or provider (for example, DigiCert) that issues Certificates.
• "Subscription": Your paid plan for ongoing Services (monitoring, alerts, tools, support, etc.).
• "Order": A purchase of a Subscription and/or Certificate-related product.

3) Eligibility & Account Registration

You represent that you are at least 18 years old and able to form a binding contract. You agree to provide accurate information and keep it current. You are responsible for all activity under your Account and for maintaining the confidentiality of your credentials.

4) Our Services (Value-Added SaaS)

Brandymail is a subscription SaaS platform that provides ongoing value independent of Certificate issuance timelines. Depending on your plan, Services may include:

• 24/7 monitoring of domain authentication and configuration signals (as available)
• Notifications and alerts (e.g., authentication issues, misalignment, policy gaps, configuration regressions)
• Dashboards and reporting (including trends and change visibility)
• Guided configuration support for authentication and brand enablement workflows
• Certificate-related coordination (where applicable): order intake, workflow guidance, status visibility, and related enablement steps

Important: We do not guarantee inbox placement, deliverability outcomes, or that mailbox providers will display a logo/indicator, as these depend on many external factors (mailbox provider policies, sender reputation, content, user engagement, forwarding, etc.).

5) Certificate Providers & Third-Party Terms (DigiCert and Others)

If you purchase a Certificate through Brandymail, you acknowledge:

1. Certificate issuance is performed by a third-party Certificate Provider, not Brandymail.
2. Issuance is subject to third-party validation, policies, and approval, and may require you to provide documents, complete verification steps, and respond within required timeframes.
3. You may be required to agree to the Certificate Provider's terms (including subscriber agreements and certificate practice statements) as part of issuance.

Brandymail may provide guidance and workflow coordination, but we do not control third-party approval timelines or outcomes.

6) Subscription Billing Start Date (Purchase Date)

Subscription billing begins on the day of purchase — regardless of Certificate issuance date.

When you purchase a Subscription (including plans bundled with certificate-related services), your Subscription Term starts immediately on the purchase date, even if the related Certificate is issued later due to validation timelines, third-party processing, customer responsiveness, or other factors.

This is because Brandymail provides ongoing value-added Services beginning right away, including (without limitation):

• 24/7 Monitoring
• Notifications
• Ongoing tooling, reporting, and operational support
• Other plan features that keep your sending domain healthy

7) Fees, Payment, Taxes, and Renewals

7.1 Fees

You agree to pay all fees associated with your selected plan(s) and Order(s). Fees may include:

• Subscription fees (monthly/annual)
• One-time setup or professional services (if applicable)
• Certificate-related fees (if applicable)

7.2 Payment Authorization

By providing payment information, you authorize us (and our payment processor) to charge applicable fees, including recurring fees.

7.3 Taxes

Fees are exclusive of taxes unless stated otherwise. You are responsible for any taxes, duties, or governmental assessments.

7.4 Auto-Renewal

Unless you cancel before renewal, your Subscription may automatically renew for the next term at the then-current rate for your plan.

8) Cancellations & Refunds

• Subscription cancellations take effect at the end of the then-current billing term unless otherwise specified in your Order or plan.
• Refunds (if any) may be limited due to the nature of immediate access to Services and/or third-party costs related to Certificate workflows.
• Certificate-related fees may be non-refundable once third-party processing begins or costs are incurred (including pass-through provider fees).

If you believe there was a billing error, contact support promptly.

9) Your Responsibilities (Critical for Success)

You agree to:

• Maintain administrative control of relevant domains and DNS
• Implement required DNS records or configuration changes (SPF, DKIM, DMARC, BIMI, etc.) where applicable
• Provide accurate documentation and complete verification steps when purchasing Certificates
• Use the Services only in compliance with applicable laws and third-party policies

Delays or failures caused by missing information, lack of access, non-responsiveness, or misconfiguration are your responsibility.

10) Acceptable Use

You may not use Brandymail to:

• Send spam, phishing, malware, or deceptive messages
• Violate laws or regulations (including email marketing and privacy laws)
• Infringe intellectual property rights
• Attempt to interfere with or disrupt the Services
• Reverse engineer or abuse the platform (including scraping, automated probing, or unauthorized access)

We may suspend or terminate access for violations or suspected abuse.

11) Data, Privacy, and Reports

Our handling of personal data is governed by our Privacy Policy. You represent you have the right to provide any data you submit or connect to the Services.

Where the Services process email authentication telemetry or reporting (including DMARC-related reporting where applicable), you acknowledge such data may include information about message sources, sending infrastructure, and related metadata.

12) Intellectual Property

All Brandymail software, content, branding, and platform materials are owned by Brandymail or its licensors and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services during your active Subscription Term.

13) Availability, Changes, and Beta Features

We may update, modify, or discontinue parts of the Services at any time. Some features may be offered as beta/preview and may change or be discontinued without notice.

14) Suspension & Termination

We may suspend or terminate your Account and access to the Services immediately (with or without notice) if:

• You breach these Terms
• Your use poses a security, legal, or operational risk
• Required payments are not received

Upon termination, your right to use the Services ends immediately.

15) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDYMAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• A Certificate will be issued
• Any mailbox provider will display indicators/logos
• The Services will be uninterrupted or error-free
• Deliverability outcomes will improve

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDYMAIL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDYMAIL'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO BRANDYMAIL FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

17) Indemnification

You agree to indemnify and hold harmless Brandymail and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any law or third-party rights
• Your content, domains, or sending practices

18) Governing Law & Venue

These Terms are governed by the laws of Wyoming, USA, and you consent to exclusive jurisdiction and venue in Wyoming courts for disputes arising under these Terms. (brandymail.com)

19) Changes to These Terms

We may update these Terms from time to time. If changes are material, we may notify you by email (to the primary email on your Account) and/or by posting a notice on our website. Continued use after changes become effective constitutes acceptance.
